LIMITED WARRANTY POLICY

1. Purpose

Moto Stacker® designs and manufactures premium motorcycle storage, transport and workshop solutions engineered to provide many years of reliable service.

This Limited Warranty reflects Moto Stacker’s confidence in the quality, safety and durability of genuine Moto Stacker Products.

It explains the warranty provided by Moto Stacker Pty Ltd, outlines the responsibilities of Owners and Authorised Dealers, describes the warranty claim process, and sets out the remedies that may be available if a Manufacturing Defect occurs.

Moto Stacker is committed to supporting its Products throughout their service life by providing technical support, replacement parts and responsive warranty service where a Manufacturing Defect is identified.

This Warranty is provided in addition to any rights and remedies available under applicable consumer protection laws.

Nothing in this Warranty excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded or limited.

 

2. Warranty Commitment

Moto Stacker warrants that genuine Moto Stacker Products will be free from Manufacturing Defects for the applicable Warranty Periods specified in this Warranty.

Where a valid warranty claim is accepted, Moto Stacker may, at its sole discretion and to the extent permitted by applicable law:

  • repair the defective Product or component;
  • replace the defective Product or component;
  • supply an equivalent replacement Product or component; or
  • provide another appropriate remedy.

Replacement Products and components supplied under this Warranty may be new, refurbished or incorporate updated engineering, materials or design improvements.

Any Product or component repaired or replaced under this Warranty will continue to be covered for the balance of the original Warranty Period or ninety (90) days from the date of repair or replacement, whichever period is longer, unless otherwise required by applicable law.

 

3. Scope of Warranty

This Warranty applies only to genuine Moto Stacker Products purchased:

  • directly from Moto Stacker; or
  • through an Authorised Dealer authorised by Moto Stacker to sell the Product within the applicable market or territory.

This Warranty applies only to Manufacturing Defects arising during normal intended use of the Product in accordance with the Safe Operating Instructions, Owner’s Manual and any other instructions published by Moto Stacker.

Unless otherwise required by applicable law or approved in writing by Moto Stacker, this Warranty applies only to the original Owner.

This Warranty applies only for the applicable Warranty Period commencing on the Warranty Commencement Date.

 

4. Definitions

For the purposes of this Warranty:

Authorised Dealer means a business appointed in writing by Moto Stacker to market, sell and support genuine Moto Stacker Products within an approved territory.

Genuine Moto Stacker Part means a replacement part, accessory or component supplied or approved by Moto Stacker for use with a Product.

Manufacturing Defect means a defect in materials, workmanship or manufacture that existed when the Product left Moto Stacker’s warehouse and causes the Product to fail during normal intended use. Manufacturing Defects do not include Normal Wear and Tear.

Non-Structural Component means any component of a Product that is not a Structural Component, including hydraulic components, castors, wheels, brake assemblies, rubber components, straps, fasteners, decals, protective finishes and other serviceable or replaceable components.

Normal Wear and Tear means the gradual deterioration of a Product or component resulting from ordinary use, ageing and exposure to normal operating conditions, including cosmetic deterioration that does not affect the Product’s intended function or structural integrity.

Owner means the first end-user who purchases a new Product directly from Moto Stacker or an Authorised Dealer for their own use.

Product means any genuine Moto Stacker product supplied by Moto Stacker, including complete systems, individual components, accessories and replacement parts, unless otherwise specified.

Structural Component means any welded, fabricated or load-bearing steel or aluminium component forming part of the Product’s primary structure and intended to support or transfer operational loads.

Structural Components include, but are not limited to:

  • main framework;
  • welded structural assemblies;
  • lifting blades;
  • carriage assemblies;
  • docker planks; and
  • other primary load-bearing steel or aluminium components manufactured by Moto Stacker.

 

5. Warranty Periods

10-Year Structural Warranty

Moto Stacker warrants that the Structural Components of the Product will be free from Manufacturing Defects for a period of ten (10) years from the Warranty Commencement Date, provided the Product is used, maintained and stored in accordance with the Safe Operating Instructions and its intended purpose.

If a covered Manufacturing Defect is identified during the applicable Warranty Period, Moto Stacker may, at its sole discretion:

  • repair the defective Structural Component;
  • replace the defective Structural Component; or
  • supply an equivalent replacement Product or Structural Component.

5-Year Component Warranty

Moto Stacker warrants that the Non-Structural Components of the Product will be free from Manufacturing Defects for a period of five (5) years from the Warranty Commencement Date.

Non-Structural Components include, but are not limited to:

  • hydraulic cylinders and associated hydraulic components;
  • castors, wheels and brake assemblies;
  • rubber components;
  • tie-down straps;
  • fasteners supplied as part of the Product; and
  • other Moto Stacker manufactured components supplied with the Product that are not Structural Components.

This Warranty applies only to Manufacturing Defects and does not cover servicing, adjustment, maintenance or replacement resulting from Normal Wear and Tear.

Components Subject to Wear

Certain components are expected to wear during normal use and may require periodic inspection, maintenance or replacement throughout the service life of the Product.

These components may include:

  • hydraulic seals and seal kits;
  • castor wheels and brake mechanisms;
  • rubber contact surfaces;
  • tie-down straps;
  • protective finishes;
  • decals and labels; and
  • other serviceable components subject to normal deterioration through use.

The normal wear, ageing or expected service life of these components does not, by itself, constitute a Manufacturing Defect.

However, these components remain covered by this Warranty against Manufacturing Defects for the applicable Warranty Period.

 

6. Warranty Commencement

The Warranty Period commences on the date the Product is dispatched from Moto Stacker’s warehouse (the Warranty Commencement Date).

Each Product is fitted with a permanent Warranty Commencement Date Label (“Warranty Label”) displaying the applicable month and year.

This label forms part of the Product’s identification and must not be removed, altered, defaced or obscured.

For Products supplied before the introduction of the Warranty Label, the Warranty Commencement Date will be determined using Moto Stacker’s production and dispatch records.

Where there is any inconsistency between the Warranty Label and Moto Stacker’s production or dispatch records, Moto Stacker’s production and dispatch records will determine the Warranty Commencement Date.

 

7. Product Registration

Registration is recommended within ninety (90) days of purchase to assist with ownership verification, warranty administration and product safety updates.

Registration is not a condition of Warranty coverage.

 

8. Owner Responsibilities

To maintain Warranty coverage, the Owner is responsible for:

  • reading and complying with the Owner’s Manual, Safe Operating Instructions and any other instructions provided by Moto Stacker;
  • using the Product only for its intended purpose and within its specified operating limits;
  • inspecting the Product before each use and ceasing use immediately if damage, excessive wear or abnormal operation is observed;
  • maintaining the Product in accordance with Moto Stacker’s maintenance recommendations;
  • using only Genuine Moto Stacker Parts where replacement parts are specified by Moto Stacker;
  • retaining proof of purchase and any other documentation reasonably required to support a Warranty claim;
  • notifying Moto Stacker or the supplying Authorised Dealer promptly after becoming aware of a potential Manufacturing Defect; and
  • taking reasonable steps to prevent further damage after a defect becomes apparent.

Failure to comply with these responsibilities may affect the assessment of a Warranty claim.

 

9. Dealer Responsibilities

Authorised Dealers play an important role in supporting Owners and assisting with the administration of Warranty claims.

Authorised Dealers should:

  • store, handle and transport Products with reasonable care while in their possession;
  • ensure the Warranty Date Label remains attached, legible and unaltered prior to sale;
  • provide customers with the current Moto Stacker Limited Warranty;
  • perform an initial assessment of Warranty claims;
  • collect photographs, proof of purchase and any other information reasonably required to assess a Warranty claim;
  • submit Warranty claims to Moto Stacker promptly;
  • retain reasonable records relating to Warranty claims submitted to Moto Stacker; and
  • not approve, reject or settle Warranty claims on behalf of Moto Stacker unless expressly authorised in writing.

Authorised Dealers are not required to open sealed packaging or dismantle Products solely for the purpose of carrying out a pre-sale inspection unless damage or another issue is reasonably apparent.

 

10. Warranty Exclusions

This Warranty does not cover:

  • normal wear and wear;
  • cosmetic damage, including scratches, dents, paint chips, fading, discolouration, oxidation, surface corrosion or other deterioration that does not affect the Product’s intended function;
  • damage resulting from:
  • misuse, abuse, negligence, accidents, impact, collision or improper operation;
  • improper assembly, installation, storage or transportation after the Product has left Moto Stacker’s control;
  • exceeding the Product’s rated capacity or using the Product for purposes other than those for which it was designed;
  • failure to follow the Safe Operating Instructions, Owner’s Manual or other instructions published by Moto Stacker;
  • inadequate inspection, maintenance or servicing;
  • modifications, alterations or repairs not authorised by Moto Stacker;
  • the use of non-genuine replacement parts where Genuine Moto Stacker Parts are specified; or
  • environmental conditions including flooding, fire, chemicals, salt exposure, extreme weather or other events beyond Moto Stacker’s reasonable control;
  • products with removed, altered or illegible serial numbers or Warranty Date Labels;
  • freight, transport, removal, installation, reinstallation or labour costs associated with Warranty claims unless expressly approved by Moto Stacker;
  • customs duties, import taxes, tariffs or other government charges; or
  • any indirect, incidental, special or consequential loss, including loss of use, loss of income, business interruption or damage to other property, to the extent permitted by applicable law.

The exclusions in this section do not apply where prohibited by applicable consumer protection laws.

 

11. Product Inspection Following an Incident

If the Product has been involved in any incident that may affect its structural integrity or safe operation, including a motorcycle falling from the Product, impact, collision, overload or any other abnormal event, the Product must immediately be removed from service.

The Product must not be returned to service until it has been inspected and determined by Moto Stacker, or an Authorised Dealer authorised by Moto Stacker, to be safe for continued use.

Where requested by Moto Stacker, the Owner must provide photographs, videos or other information reasonably required to assess the condition of the Product.

 

12. Warranty Claims

Owners who purchased their Product through an Authorised Dealer should contact the supplying Authorised Dealer in the first instance.

Owners who purchased directly from Moto Stacker should contact Moto Stacker using the contact details provided in this Warranty.

Warranty claims should be submitted as soon as reasonably practicable after a Manufacturing Defect becomes apparent.

A Warranty claim should include:

  • proof of purchase;
  • the Product serial number;
  • the Warranty Date Label month and year (where applicable);
  • a description of the issue;
  • photographs clearly showing the claimed defect; and
  • videos or additional information where reasonably requested by Moto Stacker.

Failure to provide sufficient information may delay the assessment of or void a Warranty claim.

 

13. Warranty Assessment

Moto Stacker aims to acknowledge complete Warranty claims within five (5) business days.

Following assessment of the information provided, Moto Stacker may:

  • approve the Warranty claim;
  • request further information;
  • request inspection of the Product;
  • request the return of the Product or affected component for further examination; or
  • determine that the claimed issue is not covered by this Warranty.

Where the return of a Product or component is requested, it should not be returned without prior authorisation from Moto Stacker.

All Warranty claims are assessed by Moto Stacker on a case-by-case basis, having regard to the information provided, the condition of the Product and the terms of this Warranty.

 

14. Freight & Associated Costs

Unless otherwise agreed in writing by Moto Stacker or required by applicable law:

  • the claimant is responsible for appropriately packaging and delivering the Product or affected component for Warranty assessment;
  • Moto Stacker will determine the most appropriate method of repair, replacement or other remedy;
  • where a Warranty claim is approved, Moto Stacker may, at its discretion, reimburse reasonable freight costs or arrange freight directly;
  • replacement Products or components will normally be supplied using Moto Stacker’s preferred freight provider; and
  • customs duties, taxes, brokerage fees, installation costs, travel expenses and any other associated costs remain the responsibility of the Owner.

15. Engineering Improvements

Moto Stacker is committed to the continual improvement of its Products through ongoing engineering, testing and customer feedback.

Products, replacement components or replacement Products supplied under this Warranty may incorporate revised designs, materials, manufacturing methods or engineering improvements without any obligation to modify or replace Products previously manufactured or supplied.

The incorporation of engineering improvements does not, of itself, indicate that earlier Products are defective.

 

16. Availability of Replacement Parts

Moto Stacker will use reasonable endeavours to maintain the availability of Genuine Moto Stacker Parts for a reasonable period after a Product model is discontinued.

Where an identical replacement part is no longer available, Moto Stacker may, in its discretion, supply an equivalent or superseded part that performs substantially the same function.

The availability of replacement parts remains subject to supplier availability and circumstances beyond Moto Stacker’s reasonable control.

 

17. Transferability

Unless otherwise required by applicable law or approved in writing by Moto Stacker, this Warranty applies only to the original Owner and is not transferable to any subsequent owner.

The transfer of ownership of a Product does not extend, renew or recommence the applicable Warranty Period.

 

18. Limitation of Liability

To the fullest extent permitted by applicable law, Moto Stacker’s liability under this Warranty is limited to the remedies expressly set out in this Warranty.

Except where liability cannot lawfully be excluded or limited, Moto Stacker will not be liable for any indirect, incidental, special or consequential loss or damage, including but not limited to:

  • loss of use;
  • loss of income or profits;
  • business interruption;
  • loss of opportunity;
  • storage costs;
  • transport costs; or
  • damage to other property.

Nothing in this Warranty excludes or limits any liability that cannot lawfully be excluded or limited under applicable law.

 

19. Consumer Rights

This Warranty is provided in addition to any rights and remedies available under applicable consumer protection laws in the jurisdiction where the Product was sold or where those laws otherwise apply.

Where any provision of this Warranty is inconsistent with a mandatory consumer protection law, that provision will apply only to the extent permitted by that law.

Nothing in this Warranty is intended to exclude, restrict or modify any statutory rights or remedies that cannot lawfully be excluded, restricted or modified.

 

20. Australian Consumer Law

For Products Supplied in Australia

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
